Child support in New York is an
extremely difficult topic because, quite frankly, the laws in New York
are unfair. It is very formulaic. The courts just apply a percentage
to the non-custodial parent, and it becomes really difficult for wage
earners that most likely earn less than $150,000 a year. So, child support is
a burden on lower wage earners. On higher wage earners, there’s a lot more
room to negotiate, and the law changes a little. “It’s not being spent on the children.”
That’s a common complaint I hear from the payors that, “I’m paying so
much money a month in child support,” maybe $4,000, $5,000, $6,000 a month, and
either the mother or the father is not spending it on the children, and that’s
what an experienced New York lawyer will get for you, because when that case goes
to trial, or there is a hearing or an argument made before a hearing examiner,
the expenses matter. And if you can prove that the money is not being spent on the
children, in the higher income cases, in many respects, we can lower that number. Our job as your lawyer is to
